Since there is no widely accepted industry standard for the calculation of product lifecycle analysis calculation (“LCA”) values, and assumptions around emissions can differ depending on databases or methods used*. HF Sinclair’s LCA Environmental Evaluation Data may be subject to change because of changes in the product specifications, changes in emission factors, or otherwise may not be comparable against similar products by other manufacturers recognizing the differences in methodology. Furthermore, since these standards do not include any definitive specifications for lubricant additive products, the LCA data is provided “AS IS” and HF Sinclair makes no representation or warranty as to the accuracy or completeness of the information disclosed to the recipient hereunder.

HF Sinclair’s environmental evaluation data (“Data”) is provided “As Is”. The provision of the Data shall not constitute any representation or warranty of any kind, whether expressed or implied, including but without limitation the implied warranties of fitness for a particular purpose or merchantability, and shall not relieve the recipient from undertaking its own investigations and tests. In particular, the receipt of the Data does not constitute an agreed quality of HF Sinclair products.

HF Sinclair’s Environmental Evaluation Data (“Data”) MUST solely be used for the internal calculation of environmental footprints and/or carbon footprints of the recipient’s products, which are produced with HF Sinclair products (“Customer Environmental Evaluation Data”). You undertake to keep the Data confidential and not reproduce, forward and/or disclose the Data to any third party unless, and solely to the extent, approved for disclosure by the prior written consent of HF Sinclair in its sole discretion.

HF Sinclair and its affiliates shall not be liable in any way for any claims, losses, damages or expenses arising out of, or in connection with the use of the data by the recipient, whether known or unknown, including any marketing, reporting or other claims made by recipient. Furthermore, any liability of HF Sinclair with regard to claims, losses or damages, which the recipient suffers through the use or through reliance upon the accuracy, quality, completeness or fitness for a particular purpose shall be excluded to the fullest extent permitted by applicable law. In the event that this disclaimer is found to be in conflict with any applicable law, then to the extent necessary to resolve such conflict and only to such extent, such disclaimer is to be deemed amended so as to be in compliance with any such law.

HF Sinclair Environmental Evaluation Data (“Data”) reflects the situation at the time such Data has been collected, and HF Sinclair shall be under no obligation to update or verify the Data or to conduct further lifecycle analysis. The Data is shared for information purposes only and is to be used at recipient’s own risk and HF Sinclair does not accept any liability for its use by any party.
